These Terms of Service (“Agreement”) govern access to and use of the Divorce RE Platform (“Platform”, “we”, “us”, or “our”) by real estate brokerages, agents, transaction coordinators, and their authorized team members (“Customer”, “User”, or “you”).
1. Software-as-a-Service & 7-Day Trial
Subject to compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable license to access the Platform. When registering for a new workspace, you may be granted a complimentary 7-Day Free Trial. Trial workspaces expire after seven (7) calendar days unless upgraded to an active paid subscription plan. We reserve the right to review, approve, or decline any workspace registration at our sole discretion.
2. Important Legal Disclaimer: NOT Legal or Family Law Advice
CRITICAL NOTICE: The Platform is a real estate transaction management, workflow, and communication coordination tool. The Platform, its owners, operators, and automated services do not provide legal advice, financial advice, or family law mediation. Marital asset division, court-ordered stipulations, standing judicial orders, and divorce decrees involve complex legal rights. Users and their clients must consult licensed attorneys and legal counsel for all legal interpretations.
3. Real Estate Licensing & Brokerage Supervision Warranty
By registering an account and using the Platform, you represent and warrant that:
- You hold an active, valid real estate license in your operating jurisdiction, or are an authorized assistant operating under the direct supervision of an actively licensed broker.
- You have full authority from your sponsoring/employing brokerage to utilize the Platform for client transaction records, communications, and files.
- You remain solely responsible for fulfilling all statutory document retention, trust accounting, and supervisory compliance obligations mandated by your state real estate licensing commission.
4. AI Features & Human-in-the-Loop Review
The Platform provides artificial intelligence and automated synthesis capabilities (including communication drafting, DISC conflict profiling, net sheet estimates, and task extraction). You acknowledge that all AI-generated outputs are unverified working drafts intended solely to assist licensed real estate professionals. You must independently verify, review, and approve all documents, calculations, and legal notices prior to dispatching them to clients, attorneys, or court-appointed referees.
5. Telephony, SMS & A2P 10DLC Acceptable Use
Platform telephony, Zoom Phone, and SMS messaging tools are governed by the Telephone Consumer Protection Act (TCPA) and mobile carrier A2P 10DLC campaign vetting standards. You agree to:
- Provide accurate legal entity and tax identification information for required carrier vetting.
- Send messages only to transaction parties who have provided prior express consent.
- Honor all automatic and manual opt-out requests (such as STOP, UNSUBSCRIBE) immediately.
- Abide by quiet hour restrictions (no automated outbound communications between 9:00 PM and 8:00 AM recipient local time).
6. Data Privacy & Party Separation
In accordance with our dual-party separation protocols, client transaction files and non-shared communications remain strictly protected under multi-tenant role-based access controls. For full information regarding our data practices, please review our Privacy Policy.
